To file for divorce in Kentucky, one of the parties must reside in the state or, if a member of the armed forces, have been stationed in Kentucky for 180 days immediately prior to the divorce filing.

Grounds for Divorce in Kentucky

Kentucky is a no-fault divorce state with only one ground for divorce: irretrievable breakdown of the marriage. If both of the parties state that the marriage is irretrievably broken, or if one has stated it and the other has not denied it, the court will make a finding after a hearing as to whether or not the marriage is indeed irretrievably broken.

If one of the parties denies that the marriage is broken, the court considers all relevant factors — including the circumstances that led to the filing of the divorce petition and the chances of reconciliation — and will then either make a finding that the marriage is irretrievably broken or continue the matter for future hearing and recommend counseling to the partners.

If the court elects to enter a decree of dissolution of marriage, the parties must live apart for at least 60 days before the decree will be entered. Living apart includes living in the same home without sexual cohabitation.
